Family Petition I-130

Form I-130, Family Petition, is the first step in the family-based immigration process, allowing U.S. citizens and lawful permanent residents to petition for their immediate or preference relatives for permanent residence (green card). This process is essential for family reunification, whether through adjustment of status within the United States or consular processing from abroad. At Hermandad Mexicana Nacional, we offer professional I-130 services nationwide, helping families throughout the U.S. and Latin America navigate the complex USCIS immigration system safely and efficiently.

Family petitions are divided into two groups according to the Visa Bulletin.

Immediate relatives have no waiting periods and include the husband or wife , parents , and unmarried children under 21 years of age of U.S. citizens.

Family preference categories are subject to waiting times and depend on the Visa Bulletin. These include unmarried children over 21 or married children of U.S. citizens , spouses and children of permanent residents , and siblings of U.S. citizens . Each case is different and must be evaluated individually.

I-130 Docs.PNG
To properly file an I-130 Family Petition, USCIS requires documentation that proves a valid family relationship between the petitioner and the beneficiary.

This includes proof of the petitioner's immigration status (citizenship or permanent residency) and documents such as birth certificates, marriage certificates, or other proof of kinship, as well as additional evidence in certain cases, such as previous marriages, divorces, or documents in another language. At Hermandad Mexicana Nacional, we review and organize all your evidence to meet USCIS requirements and reduce delays or additional applications.
